Expatriates with valid residence visas who drive using driving licences issued in their home countries will be prosecuted.

As per Federal Traffic law number 21 for 1995, amended by Law No.12 for 2007 — Article No.51, individuals who drive without obtaining valid driving licences or are found to be driving categories of vehicles not specified in their licences will be jailed and fined.

There are 26 nationalities who are allowed to drive in the UAE using licences issued in their home countries but this exemption is granted only when they are visiting the country.

Whenever those people from the 26 nationalities obtain resident visas then they need to obtain UAE driving licences.
Only nationals of GCC countries are permitted to drive in the UAE with their home driving licences.

Expatriates of any nationality residing in any one of the GCC countries and visiting the UAE are also allowed to drive using their GCC driving licence.

Citizens of 26 nationalities who are allowed to drive with licences issued from their home countries during their visit to the UAE are: Germany, Italy, Switzerland, Poland, Finland, Spain, Holland, Greece, Sweden, Romania, Belgium, Ireland, Turkey, Denmark, Austria, France, UK, Norway, US, Canada, Australia, Singapore, South Korea, New Zealand, Hong Kong and South Africa.

Nationals from Greece, Turkey, Canada, Japan and South Korea need to obtain the legal translation of driving licences from their home countries attested from their embassies or consulates in order to be able to drive in the UAE with such permits after their arrival in the country on a visit visa.

Child Visa IF Sponsored Person is Mother.


Child Visa if Sponsored person is Mother of Child and documents Required.
A mother can sponsor her children on Residence Visa if she meets the following conditions:
• Mother shall have a valid Employment Visa
• Marriage Certificate
attested by UAE Embassy abroad and the Ministry of Foreign Affairs inside the UAE.
• Birth Certificate of child attested by UAE Embassy abroad and the Ministry of Foreign Affairs inside the UAE.

• NOC in Arabic from husband to sponsor the child by mother. If the husband is out of UAE, NOC has to be attested by UAE Embassy abroad and the Ministry of Foreign Affairs inside the UAE. If the NOC is typed in other than Arabic, it should be translated into Arabic (legal).

• The sponsor’s monthly salary shall be Dh3000 + accommodation or a total ofDh4000 as per an employment contract approved by the Ministry of Labour. The Contract to be attested from Immigration Department on payment of Dh130.
• Government / Semi-government / Free Zone Employees do not need to attest their Salary Certificate.
• Teachers who want to sponsor their children shall be exempted from the salary condition.  
• University degree must be attested from UAE Embassy abroad and Foreign Affairs in UAE and to be translated (legal) into Arabic if the applicant's profession is other than Nurse, Doctor, Engineer or Teacher.

• Tenancy Contract (accommodation rental agreement). It has to be attested through Ejari online system of Real Estate Regulatory Authority (RERA).

• Bank statement of last three months if the applicant's profession is other than Nurse, Doctor, Engineer or Teacher. Online printed statement will not be accepted.

• Husband should not be eligible by salary to sponsor the child. Husband's
Labor Contract to be attached with application if he is inside UAE.
• Mother can sponsor her unmarried daughters and under 18 years old sons, excluding university or college students provided that a certificate proving the same shall be submitted.
DIVORCED: In case of divorced, the children custody verdict of a court should be submitted.
SINGLE MOTHER: In case of Single Mother, you can submit custody Verdict of Court, Certificate from Local Authority or Affidavit from your Consulate. If the certificate issued from your home country it should be attested by UAE Embassy in home country and Foreign Affairs in UAE.

Life Time Ban in UAE (IF)!



Which acts would result in the termination of an employment contract, and result in the employee being banned from working in the UAE for one year?

The following acts by the employee would render the employee banned from working in the UAE for a year.

1. If the employee leaves his employment without a justified cause before the end of a specified there in the employment contract; or

2. In the case of an unlimited contract without giving one month’s notice of termination; or

3. The employee leaves his employment before the lapse of one month’s notice; or

4. The employee violates Article 120 of the Law; or

5. The employee works with another employer full/part time at the same time as working for his original employer.

These sanctions would only be applied if a complaint was filed by the employer requesting such.

I was working for a company here. I was blacklisted forever due to a theft case in 2005. Now a company has appointed me at the Sharjah Hamriya & Jebel Ali free zone. Is it possible that I can get an employment visa on the company sponsorship for two years?

Blacklisting or a ban is a legal mechanism in the UAE that prevents a resident or an employee from re-entering into the UAE, or from accepting any employment position with a new employer for a fixed period of time.

Workers and visitors may be subjected to an entry ban or a work ban, depending on what they have done while they were in the UAE. Blacklisting or ban could be broadly categorised into two types i.e. employment ban and immigration ban.

In an employment ban, A person is not permitted to work in the UAE for a specific period of time due to breach of certain provisions of the UAE Labour Law. An employment ban is usually given under the following circumstances:

A permanent ban is usually imposed on absconding employees.

A ban for a period of six months will be automatically imposed by the Ministry of Labour, in case if a worker has not completed two years with his current employer. An immigration ban is usually imposed for serious labour offences or crimes committed by person. Therefore, an immigration ban means that one cannot enter the UAE, irrespective of whether the person intends to enter as a visitor or for residency. Since you were convicted of theft, an immigration ban was imposed upon you. Therefore, you will not be allowed to enter into the UAE.
I have been working in a company here on an unlimited contract. I have resigned recently with 30 days notice period. I would very much appreciate if you kindly advice me on the labour ban, if any, end of service benefits, and my passport which they kept with them.

First of all, the employer does not have the right to hold the employee’s passport without the latter’s consent. Secondly, according to Articles 125, 131, 132,133 and 137 your end of service benefits are; a certificate of service (free of charges), the expenses of sending you back to your home country (a ticket and any other agreed upon expenses according to the labour contract), and your gratuity would be the salary of 21 days for each year divided by three. Finally, Under the UAE laws, if an employee leaves a job without completing two years, then, the Ministry of Labour will impose a work ban for six months or for one year if requested by the employer (KT).

How can I apply residence visa for my parents?

 If the Applicant is a Government / Semi-government or Free Zone Employee, Salary Certificate does not need to attest. Should bring both of parents, otherwise attested death/divorce certificate or any other reason to be submitted.  Affidavit letter (Dependency Certificate) attested from Consulate stating that you will take care for the sponsored parents and be responsible for their well being. Dh2020 to be deposited after approval. This amount is refundable after cancellation and exit. Parent(s) should be in UAE on Visit /Tourist visa while applying residence visa for them. This condition may be exempted if parent(s) had visited UAE before.
RESIDENCE VISA FOR PARENTS IN U.A.E

Documents Required for Affidavit from Indian Consulate (IVS Centre):  
 Original passport and copy of sponsor Passport copy of parent(s) Form will be filled by IVS staff. You have to specify your number of brother(s), sister(s) and where do they live. Attestation Fee: Dh134 (for each parent - including typing). Attested Affidavit will be issued after 30 minutes.

STEPS TO FOLLOW
 Type Entry permit residence visa application from typing centre and attach above mentioned documents and submit at the Humanitarian Case Counter of the Immigration head office in Jafiliya (Counter No. 22 & 23, Main Building, Main Entrance, First Left). Pay Dh.130 there for initial approval sticker. If the documents are complete, they will give a token with reference number. After five working days you will receive an SMS either accepted or rejected. If the application is accepted, you will have to pay Dh2020 as deposit for each parent and Dh.680 to issue visa inside country for each.

 Type Status Change form for Dh570 (typing extra) and submit at any of the Immigration counter before the expiry date of Visit Visa/Tourist Visa. Medical, Emirates ID and visa stamping to be completed within 60 days from the date of entry/Status Change Parents' visa will be stamped for one year and to be renewed every year.• Visa stamping Fee: Dh170 + service.

Business Visa to Saudi Arabia

Required Documents:


• Invitation letter from a company in Saudi Arabia attested by Chamber of Commerce
• Commercial Register Copy of inviting company
• No Objection Letter in Arabic from the sponsor (UAE)

Family Visa for UAE

How can I apply for family visa in Dubai?

Required Documents: 

• Prepaid e-form application (available at Typing Centre)
• Passport copies of wife & children
• One photograph (white background) of each sponsored person.
• Sponsor's passport copy, Labour Card copy and Emirates I.D and Copy
• Attested Marriage
Certificate (Attestation) from UAE Embassy in home country and Foreign affairs in UAE.
• Attested Birth Certificate of child (Attestation) from UAE Embassy in home country and Foreign affairs in UAE.
• Tenancy Contract (accommodation rental agreement). It has to be attested (Ejari) throug 
online system of Real Estate Regulatory Authority (RERA). If the Agreement is on Company name you should add your name in bracket).
• Employment Contract to be attested from Immigration Department provided that the salary shall not be less than Dh4000 or Dh3000 + accommodation. If the Applicant works with government or semi-government department, then salary certificate does not need attestation.
• Confirmation letter in Arabic for daughter older than 18, stating that she is still not married. Parent (sponsor) has to be signed on the letter.
• Last three months bank statement if the profession is weak or basic salary is less thanDh3000. Online printed statement will not be accepted.
Weak professions include:
 Follow up clerk, Archives Clerk, Insurance Clerk, Sales, Sales Representative, Sales Executive etc.
Non-eligible professions include: Light Vehicle Driver, Messenger, Eye Glasses Salesman, Maintenance Mechanic General etc.
FEES
Dh220 Application Fee + service charge to be paid at Typing Centre.
Dh130 to be paid at Immigration Counter for Salary Contract attestation (If the applicant is a private company employee).
Visa holder should enter UAE within 60 days from the date of issue and should complete Emirates I.D, Medical and Visa Stamping within 60 days from the date of entry/status change. If the the visa holder couldn't enter UAE within 60 days from the date of visa issue, visa can be renewed against payment of Dh220+Service charge. This renewal is allowed two times.
If the sponsor isinvestor/partner, the following additional documents are required:
• Trade License copy & partners List (second page of license)
• LLC Agreement (share value should not be less than Dh70,000)
• Investor visa guarantee deposit receipt copy (Dh10,000 deposit receipt for LLC Partner and Dh20,000 deposit receipt for ( Professional Licence)
No need immigration clearance for wife when she comes on Residence Visa under husband's sponsorship.
STATUS CHANGE: 


If family is inside the country on Visit visa or Tourist Visa you have to payDh680 at the Immigration to issue visa inside the country.
• After get issued the visa, type Status Change form from Typing Centre and pay there Dh570 (typing fee extra). Sign the form and submit it at the Immigration along with original passport. It can be completed same time. Then type Emirates I.D, Medical and Visa Stamping

Cheating Tricks 1:
If you have been pail full amount for visa and you don’t have any written slip on company letter head or Companies Email Address so keep in mind you lost your amount now because this is the business in UAE.
Cheating Tricks 2:
When Company Call someone, ask the amount, if receive the amount so provide visa and cancel the employment with the reason of no satisfaction within 02 months before contracting and send the Labor in his home country and claim the amount of bank guarantee from Labor office which is 3000 Dhs. Some times after receiving the amount they can’t provide you visa and in this case they earn all 8000 Dhs. r any amount which you have paid.
Cheating Tricks 3:
Sometimes they give you visa and job but they can’t provide you joining and after 10 or 15 days or any time they reporting you abscond so in this case your employer can earn all 3000 Dhs. Of Bank guarantee or any amount which will you have paid other than 6500 which is the real amount of employment visa including Bank guarantee if company category is C.
Cheating Tricks 4:
Some Cheaters from other nationalities with involvement of UAE Nationals are doing this business.
First of all they will establish a fake company with the help of UAE National and Some Typing Center workers and after establishing a company they sale visas. And recruit the labor when labor comes in dubai then UAE National which is called Kafeel claim the amount of Kafalat from Company owner but company owner not paid the kafalat amount in is ( is metual understanding between kafeel and Company Owner) and after not receiving the amount of kafalat then kafeel will go in DED Court and complaint the company owner but company owner not available in UAE so in this case company will ban and visas will cancel in very soon or may be abscond report from the kafeel against labor so life time ban.
How they manage: I will tell you:
As I told you there is understanding between Kafeel which is UAE National and Company owner.
When Kafeel abscond the employees of the fake companies at that that time company owner leave the UAE and returned back in home country or other country so employee will face all the situation his or herself and when absconds employees will deported from UAE to Home Country at that time Kafeel will inform his partner fake company Owner and he will return back immediately in UAE.



What is Abscond Reporting

Abscond reporting is a law and a facility for Sponsor or employer against employee or a tourist If employee or tourist will slip and not join the sponsor’s company and cheat to his/her employeer. But most of time it is using in cheating to employees and candidates of employments.
